Terms of Service

Owner: T.I.M.E. Consulting LLC (“T.I.M.E.,” “we,” “us,” “our”)
Application: Anchor Point (the “Service”)

  1. Agreement to These Terms
    These Terms of Service (“Terms”) govern your access to and use of Anchor Point. By clicking “I
    Agree,” creating an account, or using the Service, you confirm you have read, understood, and
    agree to be bound by these Terms, our Privacy Policy, and our Acceptable Use Guidelines
    (together, the “Agreement”).
    If you do not agree, do not use the Service.
  2. Who May Use the Service
    You must be at least 18 years old and able to form a binding contract. You represent that you are
    an adult caregiver, parent/guardian, educator, or professional with appropriate authority to use
    the Service and to input any information you provide.
  3. Educational Only; Not Therapy; Not Emergency Support
    Anchor Point provides educational and informational guidance only. It does not provide
    medical, psychological, therapeutic, legal, or clinical advice, diagnosis, or treatment, and it does
    not create a therapist-client, doctor-patient, or other professional relationship.
    Anchor Point and T.I.M.E. Consulting LLC are not licensed mental health providers, educational
    psychologists, clinical social workers, or healthcare professionals. Nothing in the Service
    constitutes or should be construed as the practice of any licensed profession.
    NOT FOR EMERGENCIES: The Service is not an emergency response system and is
    not intended for imminent safety situations. If you believe a child or any person is
    in immediate danger or at risk of harm to self or others, call 911 (or your local
    emergency number) immediately. For mental health crisis, suicidal ideation, or
    self-harm: call or text 988 (Suicide & Crisis Lifeline). Do not use Anchor Point as a
    substitute for emergency or crisis services.

Mandated Reporter Notice

Anchor Point does not satisfy any mandatory reporting obligation. If you are a mandated
reporter under applicable state or federal law, you remain solely responsible for determining
whether and how to make required reports to appropriate authorities, regardless of any
guidance provided by the Service.

  1. AI Features; Governance; No Reliance; User Judgment
    The Service may provide outputs using automated systems, including artificial intelligence (“AI
    Output”).
    Anchor Point uses AI within a governed system designed to operate according to defined
    human-approved frameworks, evidence standards, safety boundaries, and response rules, which
    we continue to develop and refine. The AI model does not independently determine Anchor
    Point’s standards, policies, or content rules. These controls are intended to improve consistency
    and safety but cannot eliminate the possibility of error.
    AI Output may still be incorrect, incomplete, misleading, inappropriate, or unsuitable for a
    particular person or situation. You agree that:
    ●​ You will use AI Output as general educational guidance and not as medical, mental health,
    legal, educational, or other professional advice.
    ●​ You remain responsible for how you interpret, evaluate, and apply AI Output.
    ●​ You will use your own judgment and consider applicable professional guidance,
    organizational policies, training, safety requirements, and laws before acting on AI
    Output.
    ●​ AI responses are generated automatically and ordinarily are not reviewed by a licensed
    professional before they are provided to you.
    ●​ AI systems and the information used to develop or support them may contain limitations
    or biases and may not perform equally across all cultural contexts, family structures,
    individual circumstances, disabilities, developmental profiles, or behavioral presentations.
    ●​ Anchor Point’s governance and safety controls reduce certain risks but do not guarantee
    that every AI Output will be accurate, complete, appropriate, or safe for every
    circumstance.
  2. Account Registration and Security
    You agree to provide accurate information and keep it current. You are responsible for
    safeguarding credentials and all activity on your account. Notify us at
    Info@anchorpointcalminthestorm.com if you suspect unauthorized access.
  3. Acceptable Use
    You agree to use the Service lawfully and in accordance with our Acceptable Use / Community
    Guidelines, incorporated by reference and available at
    anchorpointcalminthestorm.com/acceptable-use. By creating an account, you acknowledge you
    have reviewed the Acceptable Use Guidelines. We may suspend or terminate access for
    violations or for conduct that creates risk of harm, legal exposure, or misuse.
  4. User Content
    “User Content” includes information, prompts, notes, and other content you submit.
    You represent and warrant you have the right and authority to submit User Content, including
    any information about a child or family, and that doing so does not violate any law or third-party
    rights.
    You grant T.I.M.E. a worldwide, non-exclusive, royalty-free license to host, store, process,
    reproduce, and display User Content solely to provide, maintain, secure, and improve the
    Service and as described in the Privacy Policy.
  5. Intellectual Property
    The Service and T.I.M.E. materials (frameworks, templates, text, graphics, logos, design,
    software) are owned by T.I.M.E. and protected by law.
    Limited license: We grant you a limited, non-exclusive, non-transferable, revocable license to
    access and use the Service for personal or internal organizational use.
    Restrictions: You may not copy, reproduce, modify, distribute, sell, sublicense, reverse engineer,
    scrape, automate extraction, bypass limits, or create derivative works except as expressly
    permitted in writing by T.I.M.E.
  6. Feedback
    If you submit feedback, you grant us the right to use it without restriction or compensation.
  7. Third-Party Services
    The Service may integrate or link to third-party services. We are not responsible for third-party
    content, policies, or practices. Your use is at your own risk.
  8. Disclaimers
    TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS”
    AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED,
    INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND
    NON-INFRINGEMENT.
    WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE SERVICE OR THAT AI
    OUTPUT WILL BE ACCURATE OR SUITABLE.
  9. Limitation of Liability
    TO THE MAXIMUM EXTENT PERMITTED BY LAW:
    (A) WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL,
    EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR
    GOODWILL.
    (B) OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF: (I) AMOUNTS YOU
    PAID IN THE 12 MONTHS BEFORE THE CLAIM OR (II) $100.
    Some jurisdictions limit these exclusions; in that case, they apply to the fullest extent permitted.
    Nothing in this section limits liability for: (a) death or personal injury caused by our negligence;

(b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be limited under
applicable law.

  1. Indemnification
    You agree to defend, indemnify, and hold harmless T.I.M.E. and its owners, officers, directors,
    employees, contractors, and affiliates from claims and expenses (including reasonable attorneys’
    fees) arising from your use, your User Content, or your violation of the Agreement or law.
  2. Suspension and Termination
    We may suspend or terminate access if we believe you violated the Agreement or created risk.
    You may stop using the Service at any time.
    The following sections survive termination of this Agreement: Section 7 (User Content), Section
    8 (Intellectual Property), Section 9 (Feedback), Section 11 (Disclaimers), Section 12 (Limitation
    of Liability), Section 13 (Indemnification), Section 15 (Dispute Resolution), and Section 16
    (Governing Law).
  3. Dispute Resolution
    Informal resolution first: Contact Info@anchorpointcalminthestorm.com and allow 30 days to
    try to resolve the dispute before initiating formal proceedings.

Binding Arbitration

Any dispute arising out of or relating to this Agreement or the Service will be resolved by final,
binding arbitration administered by the American Arbitration Association (“AAA”) under its
Consumer Arbitration Rules, rather than in court, except for matters eligible for small claims
court.
Opt-Out Right: You may opt out of this arbitration agreement by contacting
Info@anchorpointcalminthestorm.com within 30 days of first creating your account or first
using the Service. Your opt-out notice must include your name, email address, and a clear
statement that you wish to opt out of arbitration. Opting out does not affect any other part of
this Agreement.

Class Action Waiver

YOU AND T.I.M.E. AGREE THAT EACH MAY ONLY BRING CLAIMS AGAINST THE OTHER
IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER
IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

  1. Governing Law
    These Terms are governed by the laws of New York, without regard to conflict of laws principles,
    except where federal law preempts.
  2. Changes

We may update these Terms. The “Last Updated” date will change. Continued use after updates
means you accept the updated Terms. We will provide notice of material changes via in-app
notification or email.
